Just my personal observation, Derek. I have to believe you'd be doing better with your eBay auctions if you took Paypal. Certainly "postal money order only" has stopped me from bidding on more than one of your items.

DON: no disrepect inteded, but PAYPAL is good & it is bad... i hope ( not that i like it ) that i have had items listed on EBAY too that you would have bid on, but didn't because i do NOT take PAYPAL... althou, i do, IF buyer is willing to pay the fee..... it is hard enough to make a buck between EBAY & PAYPAL fees unless you are in the 70% ( guess ) of EBAY sellers that use SHILL bidders which i am not.....putting that aside, the thing that i really don't like about PAYPAL is that UNLESS you have INSURANCE thru them AND use THEIR postal shipping system & INSURE the packaged item should a buyer claim that they DID NOT recieve the item or returned it ( both lies ) PAYPAL can & does take the $$$ back from seller & returns it to the buyer... EVEN if seller has PROOF that item was insured &/or item was sent.... having a postal receipt showing the item was shipped to the CITY that buyer lives in is NOT good enough... so i hope you can have some sympathy for those sellers who do not take PAYPAL.... joe

Dear Joe,

You are absolutely correct in your Forum message. I sent some items to London, and this sale had nothing to do with eBay. The buyer claimed he did not receive them and filed a dispute with PayPal. I provided irrefutable, incontrovertible proof the items had been sent. This meant nothing to PayPal, which found in favour of the buyer. As I always withdrew funds immediately from PayPal to my chequing account, fortunately there was no money for PayPal to seize (which it would have done immediately). I had a second PayPal account, also with no balance, but PayPal cross-collateralised the two accounts. I made it crystal clear to PayPal I was not going to issue any refund for goods I had proved I sent. PayPal froze both my accounts, although it never did question my having sent the goods. It was enough for PayPal that the buyer stated he did not receive them and I could not prove otherwise. PayPal, then, holds a seller to an higher standard than the US government holds the USPS or the British government holds the Royal Mail, neither of which unconditionally guarantee delivery of the mail, just to make their respective best, good-faith efforts to deliver it. During this ordeal, I also learned sellers are on the hook if an item gets damaged in transit, or a buyer says it was damaged in transit , because a damaged item is not in the same condition as originally described. PayPal does not care whether the item was insured. On top of that, PayPal does not recognise any waiver a buyer might make, e.g., a buyer remains protected by PayPal, at the seller's risk, even if the buyer declines insurance. To make a long story short, once PayPal freezes or locks an account, the account may not be closed. PayPal refused to close either of my two accounts, even though one of those accounts had no claim against it. The best I could manage, after telling a supervisor at PayPal I rejected the user agreement, was to get all my account information offline, to prevent either account from being accessed or otherwise hacked. Technically, though, the accounts are active yet "permanently locked". All my details remain on file with PayPal and there is nothing I can do about it except wait for the next class action lawsuit against PayPal and eBay to be filed!

Good points, indeed. And I've learned (not the hard way fortunately) to protect myself as well as possible when selling through eBay via Paypal; always requiring delivery confirmation and making it explicitly clear that the seller is at his / her own risk by declining insurance (insurance often being neither cost effective nor convenient) which I always offer.

There is a flip side to this, of course. As a buyer with no knowledge of Derek, who's just changed his eBay id, I should be rather reluctant to send unrecoverable funds in any significant amount in blind faith. As pointed out, there are innumerable scam artists on eBay. Personally I wouldn't be reluctant (regarding Derek that is) but while personal check hold until clears might be just fine with me, the "postal money order only" because I don't trust folks (yes he said that) bit is a non-starter.

All of the above aside -- I've watched Derek's several recent auction items consistently bring noticeably less than I would believe they are worth, or at least what I believe they would have sold for, were a secure payment option offered. That was what prompted my original comment.

Derek -- please forgive my third person reference throughout. Also my apologies if required; how you choose to conduct business is clearly none of my business

can i defend myself for a moment?
I have 100% positive feedback. 87 transactions prove i am legit. I only changed my user id cause my sister found me online. I thought by changing my user id things would be better, well it didnt make a damn bit of difference. I now wished i never changed it. My sister is a blabber mouth and no one in my family knows i collect handcuffs and no one in my family needs to know i spent thousands of dollars on cuffs in last 3 months. I recently inherited a large sum of money and no one needs to know ive been spending aunt bernices money on handcuffs. PERIOD!!!
well now ya know why i did what i did!

There is no way to falsify feedback. i changed names but cant change comments or feedback! 100% perfect record!!!!!! 100% honest, 100% fast pay, 100% fast ship, 100% satisfied customers. My comments on my ebay reflect one thing. I am honest. Ive dealt with many people here. Lot of people know who i am. Joe tanner might recognize my name off hand. but i bought my hiatt 1970, my munitions cuffs,japan cuffs,alcyon fitwell cuffs and other items from joe.
Phil Ingram has done lots of business with me. He sends me cuffs before i can even get to post office. I send payments fast too! He knows i am a man of my word and i am trustworthy. I recently traded with stan willis. all these people are in my feedback. please take time and research. I AM NOT A SCAM ARTIST!!!!!
I tried emailing Don personally to introduce myself and so far no response.

but, anyone who knows ebay knows paypal sucks! anyone who has a checking account knows checks bounce, there is a 5 to 7 day delay for bank to process the check. A $22 fee if it bounces etc. happened to me once and never again!!!! I got charged $22 cause a check bounced for a $4 cd. GREAT HEH? U.S. postal money order is safest way to send money!
It is U.S. government! I need a drivers license to cash them. they write my drivers license # on it. it has serial numbers, tracable etc.

i just told my girlfriend how i was bummed out cause people at handcuffs.org think the worst of me. She told me its probably a ploy to keep bids low. Dont be surprised one bit if Don walk away winning bidder.

Some people also do that stuff though and u have to admit it. shill bidding and all the other sneaky underhanded tactics even the "honest" people use. we arent safe anywhere. i just revised my auction listing, i forgot to mention the most important feature of these cuffs!!!!!!!!! the serial number!!!!!!!!!!!!!!!
they are # 002544
you have to admit thats a low serial # ! Most likely one of the first batch made. anyone know how many of these smith and wesson produced?

Export Control Program Description and Licensing Policy
The United States controls exports of crime control items, as required by Section 6(n) of the Act, to reflect its concerns about the observance of human rights in various countries of the world. The U.S. Government requires a license to export most crime control and detection instruments, equipment, related technology, and software to any destination, except Australia, Japan, New Zealand, and members of the North Atlantic Treaty Organization (NATO). A license is required for certain crime control items including restraint type devices (such as handcuffs and shackles) and discharge type arms (such as stun guns and shock batons) to all destinations except Canada. Specially designed implements of torture and thumbscrews, which are considered part of the crime control category, require a license for export to any destination.


So, if I read that correctly, handcuffs require an export permit to ANY country EXCEPT Canada.

While stun guns and shock batons may be legally allowed to be shipped to Canada from a US perspective, both items are considered prohibited weapons in Canada, and will be confiscated by authorities if/when found entering the country.

Further to my previous message; Discount Handcuff Warehouse, Peerless, S&W and many others all have disclaimers for International purchase and will only sell to the US or Canada without permits. Some won't even ship beyond those two countries.

In response to the initial thread of not accepting PayPal, let me just say that being able to use PayPal is fantastic from a buyers perspective, and I would never dream (as I'm sure most of the legit users of eBay also) of doing a chargeback as a means to scam anyone.

I can understand some sellers reluctance, knowing how PayPal operates so unfairly. I have used PayPal for all my auctions (selling) and have never once had ANY problems. The two times something went wrong with shipping, I resolved the problem, without anyone having to do a chargeback.

Mind you, I always kept a close tab on who was bidding, constantly checking the validity of buyers the best I could. In such cases where it was suspicious or obvious bad bidders, I would simply cancel and block them.

Now that BidPay has returned, that is another option for some. Not for me yet though (as a seller) as they haven't any way to dump funds into my Canadian bank account (at least not as of the last time I checked).

Anyways, in the case of Derek only accepting postal money orders, that is not a problem for me, it just means the whole transaction takes about a week longer than usual. I have never dealt with Derek before, but I have no concerns as he comes highly recommended from a VERY trusted friend, Phil Ingram whom many of you know.

I now look forward to receiving my latest purchases from Derek.

I never had any intention of questioning his integrity, I'm sorry if I left anyone with that impression, and am convinced that Derek fully believes that as well.

Sorry - just read that you responded to my post regarding an export license needed to ship handcuffs abroad.

I should have specified that I was referring to reality - not the law.

Congradulations, you have excerpted a relevant code provision. Perhaps you work for the government.

Reality: No one cares. A package containing handcuffs will neither be confiscated by US customs when it leaves the USA, nor the receipient country's customs department.

Customs departments aren't on the hunt for a pair of old handcuffs. They are looking for drugs, bombs, and cargo containers filled with endagered species.

Do you think a single person has ever been prosecuted for shipping a pair of old handcuffs overseas?

Answer: No.

I'm not disputing the fact that you may be prosecuted for exporting a large commercial quantity of handcuffs without a permit. But single, old pairs - no way.

I like the export law excuse myself! That way I dont have to deal with these people. Thats reality!

Why deal with people who cant understand item descriptions,payment methods and hardly speak english? WHAT A HASSLE!!!!! Then having to convert currency,waiting weeks to cash their money orders which might not even be able to be cashed depending on my bank,their bank and if they sent in u.s. funds. Many are scam artists and send bogus checks and money orders. How about the simple fact my bank takes 60 days to clear international checks or money orders? How about the fact i get charged $22 for a bounced check or money order that is no good? How about spending days maybe weeks waiting for payment to arrive only to find out it isnt even good enough to wipe myself with and has to go back? Estimating shipping is a pain in the ass and filling out customs forms takes time and sucks too. Praying it gets there safely and arrives intact on top of all that? Not being able to track a package once it leaves the u.s. unless the most expensive shipping method is chosen? To hell with all of that noise! U.S. and Canada only!

Now thats reality to me and many others who rather not speak their true mind!
Not me, I never had a problem arguing my case.

Technically it isnt worth the hassle. Not directly but you even said it yourself,there is a slight risk. Sure maybe "some" customs might not confiscate one pair. BUT..... Who wants to sell a pair that are virtually irreplaceable atleast in my case anyways cause id never own another pair of 926 probably in my lifetime.Why take a chance on any of this? Who in their right mind wants to deal with the red tape? Anyone who misleads someone into sending money for an item knowing there is a law allowing customs agents to possibly confiscate that item is bunk. yes customs confiscating handcuffs is a possibility! Its a law and should be obeyed.
Plus with the above i mentioned? Its the only f'n law i can live with.

I hate PayPal, i been raped by them so many times i cant stand up w/o my intestines falling out & i am a fair and honest seller, i liked Western Union ® Auction Payments however they are a no go now they where sweet in once that email arrived stating your money order was shipped you could send buyers items right out.
