I wish Ebay would stay the same, and a-holes like you would stop posting items like this, thus ruining any of the few, rare bargains left on there. By the way, Peter, it is a violation of Federal law for these cuffs to be shipped to you. Stop taking advanatge of people's ignorance of our country's regulations. That goes for quite a few others overseas who do the same thing.

LOL That Anonymous is really making me laugh! I guess someone is afraid of us Europeans buying all nice stuff at eBay.com because of the weak US$ and the strong Euro .

No US Federal law forbids foreigners to buy handcuffs as long as they were shipped to US or Canadian postal addresses. So stop whining!

It's a big deal if you're trying to sell over there, or buy over here. And it's a good deal for exporters, as we can export more.

Guenter, I was a bit taken back by your arrogance in that post.
I am glad anonymous amuses you by trying to point out Federal Export laws, perhaps since it is my job to enforce these laws, I won't be quite so entertaining.
The customs and export regulations prohibit export of restraints from the United States to any European country. I do not give a rats ass if the seller sends them to your Grandma in Paducah, Kentucky, and she in turn, sends them to you. Are you violating the law?
No, but grandma just did. Not that you seem to care.
I think the point was being made that by bidding on these items, you are enticing persons to break OUR laws, you know the counrty with the weak dollar. This is unethical at best.
That goes for any of the rest of you that choose to knowingly bid out of country without respect to our government.
Maybe I'll be seeing you around.....

Yikes! collectors getting restraints exported to them for no other purpose than hanging them on a display rack. I really don't see why this should be against the law under these circumstances.
Perhaps its time to form some sort of association to monitor these laws and present a unified front to help protect collectors. Afterall, if this goes by unanswered then its a short step to some moral mouthy decrying ownership of restraints at all, and suddenly ALL of us are commiting a crime by being collectors and maybe have to turn over our collections....without any financial compensation.
Ask gun owners what thats like.

Hi,

what's this US vs Europe crap? Shouldn't we be happy that we have collectors all over the world sharing their knowledge, and the possibilities to get almost anything from all over the world thanks to the internet today?

Regarding exports: I am not really sure if these laws apply to private antique items sold from collector at all, or just to commercial sellers, but what is definitely wrong is that by bidding on the item breaking of law is encouraged. It is perfectly legal to export handcuffs if one applies for a license, which to my knowledge so far always was granted for idividual handcuffs shipped to germany (you don't have to pretend to be in law enforcement or something like that to get a license, so that's really perfectly legal). And if the seller doesn't want to do this and therefore a third person is involved I see no problem at all.

The laws are to prevent the large-style export of US handcuffs to some terror-regime which could use them in breaking human rights (and that's a good thing. Even tough they usually have their own which are even more uncomfortable...), not to prevent collectors from buying antiques. So if the grandmother from Kentucky really sends the package without applying for the license, I won't consider that as "breaking the law" like in drug export, but more as "saving the government agencies some work" - the license would have been granted anyway for sure - or she would get the answer "you don't need that for a private parcel to your grandson". Unfortunately I can't tell as I don't have a grandmother in Kentucky and the last handcuffs I received from the US (ASP lighweights, arrived last week) were exported using a license. Which - as always - was granted without problems.

Regarding the EUR/Dollar: yes, currently it's good for us (I also bought black Hiatt Speedcuffs from the US as it was cheaper then from the UK, sounds crazy but...) when buying handcuffs, on the other hand our exporting industry (like BMW...) suffers from that - so on the long run a balanced exchange rate (meaning a Big Mac here costs about the same as a Big Mac in the US...) would be better for everybody.

And: sure, everybody is angry when someone else buys something he wanted, sure. But calling someone an 'a-hole' who hints on an auction here (read the original post from anonymous) for sure is wrong, laughing possibly really is the best reaction. And while anonymous might be angry on "us europeans" buying stuff with the "strong EUR", the seller of the item will be happy. It's more $ for him (and therefore the US economy) after all. BTW: it also happens that someone here is outbid by a "rich american" who simply has more money - did you know we pay $3.62 per gallon of fuel at the current exchange rate (or about 5.2 cheeseburgers, giving a better impression of the real value)? So if you spend for handcuffs what you save on gas, you should be on the winning side...

First of all, I think trading benefits everyone involved, in Europe or the US. Of course I hate seeing a decent pair of Stotz, or Moabit sold to the US, but so be it. We get nice stuff in return. I'm sorry, but all that isolationist stuff just sounds pretty greedy.

And Tim, I can't believe you're pulling the cop here on us, or are you? "Uh, I'll arrest you if you buy more cuffs off ebay." Or did I get that wrong? Hell, I got outbid about 10 times on interesting cuffs just last week. Does it make me feel bad? nah.

The one major problem I can see about the export license
is the time involved going through US govt. red tape. If
a buyer pays using Paypal, there is a seven day shipping
window that if not met could be one of the buyers reasons
to get a refund and charge back to the seller.

Read the paypal agreement.

I am assuming you can get the licence prior to actual bidding and purchase? Is it a one time thing to apply or does it have to be for each purchase and shipment?
What would it cost, and has anyone ever been denied one?
Hmmm....sounds like an article for the next handcuffs annual.

First of all kudos to Martin. His reply is excellent.

Tim, I would never encourage my grandma (or lets better say my American friends) to break US laws. But I would ask them to gather this stuff for me. I myself (and friends of mine from Europe) often visit the States and then we take all the cuffs overseas. We did so in the past without any problems at the US airport check-ins.

Last but not least AFAIK my friend in Canada is allowed to ship handcuffs to Germany and US sellers are allowed to ship to Canada.

All I wanted to point out is that we Europeans are legally allowed to buy handcuffs in the States without taking unaware US sellers in. So Anonymous should not forbid Peter or any other Overseas buyer to bid at US auctions.

PS: I hope that all US buyers are aware that they should not buy leg irons from European eBay and encourage the sellers to ship to USA - that's against EU law!

Only leg irons, not handcuffs. Leg irons are considered as a torture device like an electro shocker or thumb screws. Exporting handcuffs to non EU countries is no problem at all. A real stupid law!

It is a silly law that like most laws only targets a few and not all.

Henceforth, where is the real logic in the "law" in the first place?

The US law has nothing to do with terrorists. It was written before 911. It has to do with not exporting devices that can be used for torture. Water, rope, and all kinds of readily available materials can be used for torture, but there are no export restrictions on those items. Thumbcuffs are not allowed to be exported, even with a license. The license is for a particular person at the receiving end, and is not available for individuals to obtain. Only corporations can get them. I tried many times to get answers and no one is ever available for the answers.

you are somewhat correct. the law was there before 011, and there were cases where large companies had to pay large fines for selling to Europe without the proper license. Recently the government has gone after small sellers and charged large fines. I suppose the beaurocrats have nothing better to do.
