Hello ¡¡

My name is Francisco and I am a Spanish handcuff collector.

A few members of the forum have traded with me in the past.

Some time ago the following post appeared at the forum.

I contacted the seller: uprica@outlook.com Intending to buy one of the items: American Munitions CO, Chicago ILL, B

I agreed with the seller to pay half the shipping and that the packet MUST be sent via signed for mail with tracking number to guarantee delivery.

Once the price was agreed I paid using my Paypal account.

The next day I found the money had been returned. Contacted the seller again and said that it was a mistake and that the leg irons were ready for shipment as soon as I could send the money again.

I had some doubts because this is not serious. An agreement must be met. But finally I sent the money again through Paypal.
I gave instructions to the seller to give me feedback and send me the tracking number of the packet.

Time elapsed and no news from this fellow. Contacted again and assured me that the packet would be sent the next morning.
The leg irons were not sent and therefore contact was made again.
This time the seller excused saying that he is a student and has no time to go to the mail office....
Next complaint was replied by the seller saying that he had no money to pay for the shipping ¡¡¡

When I threatened to complain through Paypal he assured that the packet had been sent but he never sent the tracking code or any other document to prove this statement.

Visa has already taken my money from my bank account but the irons are missing.

Contact again with the seller asking for a full refund. He replies to tell me that the packet that he supposedly had sent has been returned home and that my money was removed from his bank account.

Being feed up with such a lot of lies I have made a complaint through Paypal. I truly hope I can collect my money back ¡¡¡

Beware of this fellow. I would not reccomend to trade with him.

I also wonder if legal action may be initiated for fraud.

I would contact Visa.

Tell em that you did not receive goods you paid for and let them help you.

You may have a time limit on making a claim so do not delay.

Hello Francisco,
sorry to hear about your problem.

First of all you need to take some time into account for the parcel to reach you. Not sure about delivery times from the USA to Spain...but they are like 7-10 days from the USA to Germany. I'd guess that should be about the same to Spain.

If that parcel really has been returned to the sender it would of course take double the time so it might still be on the way.

If there is something on the way the seller should be able to give you a tracking number. I am guessing he would have send it via USPS in which case the parcel can be tracked on https://tools.usps.com/go/TrackConfirmAction_input. If it were going to Germany it could also be tracked on http://www.dhl.de/en.html. I am guessing that a parcel to Spain should be trackable on http://www.correos.es.

Not entirely sure about registered letters as opposed to a parcel. If I send one to the USA it can be tracked on USPS (try RG766333192DE for instance) so I am guessing one from the USA to here can be tracked too.

If the seller cannot provide a tracking number or the number does not show up on tracking I'd tell Paypal about it.
Theoretically you could tell VISA too.
Had done that like two or three times in the last years.
A simple info like 'Goods were not delivered' or as in my case 'I don't know that company, never bought from them' should be enough to get your money back.
In your case VISA would debit the money from Paypal. Not sure about the terms of Paypal here...but I am quite sure they wouldn't like that. I would imagine that Paypal would charge you some kind of fee for the reversal via VISA.
Better to do this via Paypal and leave VISA out of it.

As for legal action...theoretically yes.
But with you beeing in Spain and the seller in the USA...nah...forget about that.

Always go through credit card if you are unsure about a transaction using paypal. They try to discourage you, because it gnaws on their profit margin, but you have a degree of insurance that paypal no longer offers.

I found that packages from the US take closer to 4 weeks now; it's a shame, given they no longer surface (i.e. ship) service and charge a lot more than they used to.

The seller is from UK not US.

I started a complaint through Paypal and I think it is going to work.
I have not had my money back yet, but for what I see they have decided in my favour.
