I recall someone saying that they don't do private sales out side the US any longer .
Give Chris a call and ask. He is a great guy and will have the info.

They still ship to Canada, no export permits needed for here.

Does this mean that receiving of export licence is problematic for Europe private buyer?

I'm guessing getting a licence is a lot of paperwork.
If I were him I would not want to do the work to be able to sell...say...a S&W 100.
It's just not worth the efford.

Yea...I know...one could say that nicer.
But that's the way it is.

Apart from that I could imagine that if one were selling to the Government or alike the checks beeing done before issuing a licence would be even stricter.

Selling without a licence is possible but NOT RECOMMENDED.
I know of one company that did sell some stuff to (possibly) private persons.
They were fined $50.000 for that.
And a further $415.000 if they were to do it again within two years.
Kinda spoils your day, does it ?

If you somewhere abroad then it might be a good idea to contact someone who has a licence.
Usually the licences allow the resale within the country of destination.

For instance I could offer anything you would want within Germany.
If you are looking for a reseller in France...the UK...whereever...send a email and ask if there is someone there.

This is an interesting subject! First of all, I believe most of you agree to me that the law is really stupid as it serves
no purpose. Handcuffs are allowed in most countries and they makes no harm. The general problem of exporting handcuffs is
rather on the receiver's side, not the US side.

Only a few of all sellers know about the need of an export license. Most private sellers on eBay don't. Within the Europe
Union we have no such restrictions.

Harry, you are mentioning a company that had to pay a really high fine. I'm not questioning the truth of your story but
that's the first time I've heard of such case. Really!

I have bought several hundreds of handcuffs and leg irons from US sellers in a period of at least 15 years of time. The
sellers never had any problems of, neither did I. Nowadays, a very good friend of mine in the US keep an export license
issued in my name. I rarely buy any cuffs from the US nowadays but in such case, we use the license as we have it.

However, I would say it's more or less without any risks for a private seller in the US to ship handcuffs abroad. Why?
When you ship out a package, do the post office ask you for your identification? Probably not! Then the authorities
have no possibility to track you and charge you the fine. At least, we don't have to show our identification at the post
office in Sweden to be able to ship a package abroad.

The problem for European collectors is rather the domestic customs as they are eager to charge import taxes, even on antiques.
My piece of advice to European fellow collectors; ask the seller to state "old restraints" on the green customs declaration.
Most people employed at the customs in Europe are not educated enough to understand the foreign word "restraint". Especially as
it has different meanings. Handcuffs is only one of them. In addition, also ask the seller to state a low value on the green
customs declaration; why not $30?
Following this procedure, you probably won't have any troubles or taxes.

This subject has been dealt with before.

The bottom line seems to be that ...

It is illegal to export handcuffs (restraints) to any country other than Canada without first obtaining an export license for each and every transaction. Once obtained, the license is for "single use" only; IT IS NOT valid for any subsequent transaction, even with the same buyer.

The fine for exporting without a license can be substantial and is not worth the risk of being caught. IMO. (Humane Restraint Inc. was fined $465,000. for exporting without a license; for more info see http://www.gpo.gov/fdsys/pkg/FR-2012-07 ... -17236.htm Note that among the charges, "HR attempted to export a strait jacket ... valued at approximately $112, from the United States to the United Kingdom without the ... license required by Section 742.7(a) of the Regulations;" etc.)

Lars, I agree with you about the intelligence of this law.

The ironic thing about this export law is the way it is applied.

If you have nothing, Own nothing, Have no means to pay a fine,

Then you probably don't have anything to worry about.

As for the fine...yes...HR was the one I was refering to.

Nope...that's not quite correct. Usually a licence is issued for a certain number of items and a certain value. This licence is then valid for the specific combination of shipper and client for two years. Unless the number of items and / or the value stated on the licence has been reached before that time.

The licence is only valid for the stated shipper and is not OK for any other seller to ship to the client stated in the licence.

The licence is also not valid for the stated client's neighbour or anyone else. It usually does allow the stated client to re-sell the items though.

As for stating a low amount on the customs paperwork...yes and no. For a private client that's a possibility as the chance of discovery is not that big. And if beeing discovered when clearing the items from customs you say 'Sorry...don't know what the seller stated $30. It's gotta be $300' you will pay customs duty and VAT for the $300 but no extra fine. Importing a brand new IPhone and stating $30 as value for instance is bold. Especially with standart items customs very well knows what they are worth.
If however a shipment is beeing cleared from customs with a low amount and for whatever reason later customs gets to know about a bigger amount you'd be talking about a minor breach of law or a felony depending on the amount of customs duty / VAT not payed. This will result in a fine or even some jailtime.
Haven't heared about someone having that problem when importing handcuffs so I'd say it's a theoretical possibility. But it is there.
